UK considers shifting settlement rules from 5 to 10 years

Per May 2025 Immigration White Paper, the UK government considers raising the qualifying period for Indefinite Leave to Remain (ILR) or settlement from 5 to 10 years. The proposal is still undergoing parliamentary discussion, but it’s likely to pass into law. 

A major question is whether people already eligible for the 5-year route will be affected, since the White Paper gives no guarantee of protection. Another debated setup is “Earned Settlement,” which could allow some to qualify for ILR in less than 10 years through a points-based system. 

The proposal could reshape the settlement journey for thousands, affecting finances, career planning, and family stability.

Details of the Proposal

The main change is extending the ILR settlement period from 5 to 10 years for most visa categories. The following routes may likely be affected: 

  • Skilled Worker visas, and other employment-based routes. 
  • Innovator Founder and Global Talent visas. 
  • The Health and Care Worker visa route may be closed to new overseas applicants in adult social care. 

Partners of British citizens, domestic abuse victims, family, and humanitarian routes are likely not affected (source: House of Commons Library). 

Other Proposed Changes 

The White Paper also suggests: 

  • Increasing the level of skills required for the Skilled Worker visa. 
  • Decreasing the duration of the Graduate visa. 
  • Raising the English language requirements for some visa categories.

The proposal is still under discussion; migrants are advised to check visa routes, keep residence records, and consult accredited immigration advice. 

What Visa Holders Can Do Now

Historically, the UK government protects existing visa holders, but this time, it’s not guaranteed. Migrants should plan with the possibility that retrospective rules may apply such as by: 

  • Checking the remaining valid number of years under your current route. 
  • Keeping complete documentation of employment, tax, residence, and language papers. 
  • Taking part in consultations and petitions to help shape transitional protections. 
  • Consulting your immigration lawyer or sponsor to know your options. 
  • Staying updated with dynamic government policies. 
  • Applying for ILR as soon as you’re eligible under the current 5‑year rule.
